Judge Rules on Objections in Wells Sherman House Case

Request for oral hearing in case is denied

A Portage County judge has ruled that the court case over the relocation of a historic Kent house should not be reopened for further oral arguments. Portage County Common Pleas Judge John Enlow issued a ruling in the ongoing court case between two groups, the Kent Wells Sherman House, Inc., and Save the Standing Rock Garden, over the relocation of the Kent Wells Sherman House to the lot at 247 N. Water St. Enlow's ruling was issued in response to an objection to an earlier ruling in the case by Portage County Magistrate Kent Graham. The objection to Graham's ruling had been filed by Kent attorney John Plough on behalf of Save the Standing Rock Garden. Group files objection to magistrate's ruling

The struggle persists over the relocation of a historic Kent house to a cherished piece of greenspace. Kent attorney John Plough, representing members of the group Save the Standing Rock Garden, who oppose the relocation of the Kent Wells Sherman House to 247 N. Water St., has filed an objection to a magistrate's decision in the court case about the issue. In December Portage County Magistrate Kent Graham denied three injunction requests made by Save the Standing Rock Garden in an effort to stop the relocation of the house to the lot, which has been used — but not owned — for decades by members of neighboring Kent arts group Standing Rock Cultural Arts. It would be much more appropriate and culturally sensitive to the vibrant close knit community here to just take a few photos of the KWSH and then dismantle it. Use the historic timbers to make fittings for Ray's (an actual historic landmark) or something useful, or take any actual historic artifacts from the house and put them on display at Kent State as a part of a permanent exhibit on Kent …   more ›

UPDATE: Court Denies All Injunction Requests to Stop Wells Sherman House

Magistrate's order issued Wednesday, made public today

A Portage County magistrate has ruled that several requests for an injunction to stop the relocation of the Kent Wells Sherman House to 247 N. Water St. have all been denied by the court. Portage County magistrate Kent Graham issued his ruling in the case Wednesday, and the order became public for the first time this afternoon, essentially allowing the relocation of the house to the vacant lot between the Scribbles Coffee building and the Standing Rock Cultural Arts gallery. Kent residents under the banner Save the Standing Rock Garden filed requests for injunctions last month against the Kent Architectural Review Board, Kent Planning Commission and the Kent Wells Sherman House, Inc., board to try and stop the relocation of the historic …

Alec, the people who have raised their voices to oppose the move of the house are certainly passionate about it, but they are not most Kent residents. They are a vocal small group of residents. I admire their willingness to stand up for what they believe, even though I disagree with them on this issue. But they are not most people in the city. Court Denies Request to Stop Relocation of Kent Wells Sherman House

Magistrate issued order this week in case

A Portage County magistrate has issued an order denying a request from a group of Kent residents to stop the relocation of the historic Kent Wells Sherman House to a vacant lot at 247 N. Water St. Portage magistrate Kent Graham issued the ruling this week, which denies the request of members of the group Save the Standing Rock Garden for a preliminary injunction to stop placement of the house on the lot. "The motion for a preliminary injunction ... prohibiting (Kent) Wells Sherman House, Inc., from disturbing or removing trees, plants, and soils, making any excavation, and placing structures or equipment on its property located at 247 N.
