No Ruling on Injunction for Wells Sherman House Relocation

Court considering permanent injunction request against relocation of historic house to North Water Street site

A Portage County magistrate has yet to rule on a request for a permanent injunction to stop the relocation of the historic Kent Wells Sherman House to a vacant lot at 247 N. Water St. Portage County Magistrate Kent Graham listened to testimony from several witnesses Tuesday as Kent attorney John Plough argued for the injunction on behalf of the Kent citizens' group "Save the Standing Rock Garden." Earlier this month, Portage County Common Pleas Court Judge John Enlow issued a temporary injunction on behalf of the group, which is comprised of supporters of the Standing Rock Cultural Arts, that temporarily stopped site work for relocation of the historic house. Court appeal by citizens group has hearing on permanent injunction request Tuesday

The court battle over the relocation of the historic Kent Wells Sherman House has so far slowed the project with a temporary restraining order. Portage County Common Pleas Court Judge John Enlow issued a temporary injunction on behalf of the Kent citizens' group titled "Save the Standing Rock Garden," comprised of supporters of the Standing Rock Cultural Arts, that temporarily stops site work at 247 N. Water St. for relocation of the historic house. Enlow issued the temporary order this month. Common please court filing alleges commission decision "unconstitutional"

A group of Kent residents trying to preserve a small patch of greenspace are asking a Portage County judge to overturn a ruling by the Kent Planning Commission allowing the relocation of the historic Kent Wells Sherman House. The group titled "Save the Standing Rock Garden," comprised of supporters of the Standing Rock Cultural Arts, filed an appeal in Portage County Common Pleas court this month to the September planning commission ruling that approved a site plan for the historic house at 247 N. Water St. The appeal seeks to overturn the commission's approval of the site plan, which permits relocation of the house to the lot that has been used by the arts group for the past 20 years. Planning Commission turns down site plan for North Water Street relocation of historic Kent Wells Sherman House.

Three of five Kent Planning Commission members chose green-space preservation over saving a Civil War-era home from possible demolition by rejecting plans Tuesday for relocating the Kent Wells Sherman House to a vacant North Water Street parcel. Commission members Anthony Catalano, John Gargan Jr. and Peter Paino voted against approving a site plan for the non-profit Kent Wells Sherman House Inc., a group formed in March to save the historic structure found to have ties to the Kent family and other prominent citizens. I travel too much for work, and clean too many yards to worry about cutting down a bunch of weeds in a property that personally looks like trash. If it were upto me, if would cut 80% of the stuff down and replant something worthwhile. But hey, thats me.
