The developer that bought the Silver Oaks Place retirement community reached a settlement with 49 of its former residents
A confidential settlement reached last week between 49 former Silver Oaks Place residents and the developer who forced them out isn't the end of the story. Attorneys for the current owners of the retirement complex, Tell Real Estate Trust, and the prospective owner, Alabama-based Capstone Development Corp., reached the agreement with the seniors through mediation led by the Ohio Civil Rights Commission. The inclusion of a confidentiality clause means the Silver Oaks seniors who participated signed an agreement that they wouldn't disclose the details of the settlement. Only the seniors of Silver Oaks Place, their closest supporters and the attorneys involved know what happened at a mediation session in Cleveland Wednesday. About 20 seniors trekked from the retirement complex near Kent State University to downtown Cleveland Wednesday for the mediation, which was led by the Ohio Civil Rights Commission. A group of the remaining residents at the retirement complex hope for a resolution
The few remaining residents of Silver Oaks Place traveled to downtown Cleveland this morning hopeful for some resolution to their forced eviction. Noted civil rights attorney Avery Friedman, who has taken up the seniors' case, helped arrange a mediation session with lawyers for the current owners of the retirement complex, Tell Real Estate Trust, and the prospective owner, Alabama-based Capstone Development Corp. The Ohio Civil Rights Commission is mediating the session. Capstone signed an agreement with Tell to buy the property by Dec. 31, 2011. Ohio Civil Rights Commission will review the issue with all parties this month in downtown Cleveland
A mediator from the Ohio Civil Rights Commission will sit down with residents of Silver Oaks Place and attorneys for the current and future property owners at a meeting this month. The OCRC has reserved the second floor of the Lausche State Office Building in downtown Cleveland to meet with residents and attorneys for Tell Real Estate Trust, the property owner, and Capstone Development Corp., which plans to buy the 13-acre complex by the end of 2011. Avery Friedman, the civil rights attorney representing the remaining residents of Silver Oaks, said both Tell Real Estate and Capstone have hired law firms to work on the issue. Laws about age discrimination work both ways. So creating a law that prevents this instance from occurring would also create an unlawful scenario by creating communities geared specifically for elderly individuals. Isn't that correct??
