Council votes to loan $15,000 to historic house relocation effort
Kent City Council voted Wednesday to lend $15,000 to the effort to relocate the Wells Sherman House — but not without some opposition. Councilmen John Kuhar and Wayne Wilson voted against releasing the money for the loan, which will be used as part of the effort to permanently relocate the house to the greenspace at 247 N. Water St. Kuhar called the loan bad business on the city's part because there is no set promissory note or legal mortgage for the loan that spells out what would happen if the non-profit group receiving the loan, Kent Wells Sherman House, Inc., defaults on repayment. "I have yet to see a finished copy of the actual promissory note or mortgage note, but evidently there’s not going to be any mortgage because we’re not …

Magistrate hears attorneys' arguments, gives time for written briefs
The court case over the relocation of the historic Kent Wells Sherman House to greenspace on North Water Street continued Friday in Portage County Common Pleas Court. Portage Magistrate Kent Graham listened to attorneys for the city of Kent, the non-profit Kent Wells Sherman House Inc. and Save the Standing Rock Garden — the group trying to prevent the relocation — without ruling on the matter. Friday's hearing was held so attorneys could argue their cases over Save the Standing Rock Garden's request for a permanent injuction to halt the relocation of the house to the lot at 247 N. Water St., which is owned by Kent Wells Sherman House Inc. After less than an hour Graham told the attorneys they had until mid March for John Plough, counsel …

Terms of repayment, other details to be talked about in committee
Kent City Council will take another look at the $15,000 loan to Kent Wells Sherman House, Inc., for relocation and restoration of the historic house. Council voted recently to put the issue back in to a future committee meeting to review the details of the loan, which was originally approved in June 2012. Councilman Roger Sidoti, who suggested the review, said he wanted to see details such as when the city will release the money and the term of the loan hashed out. "I think there are two issues here," Sidoti said. "In good faith we are extending a significant portion of taxpayer money to the house. Obviously they are sitting on some issues they haven’t quite got rectified ... for the placement of the house." The Kent Wells Sherman House …

Request for oral hearing in case is denied
A Portage County judge has ruled that the court case over the relocation of a historic Kent house should not be reopened for further oral arguments. Portage County Common Pleas Judge John Enlow issued a ruling in the ongoing court case between two groups, the Kent Wells Sherman House, Inc., and Save the Standing Rock Garden, over the relocation of the Kent Wells Sherman House to the lot at 247 N. Water St. Enlow's ruling was issued in response to an objection to an earlier ruling in the case by Portage County Magistrate Kent Graham. The objection to Graham's ruling had been filed by Kent attorney John Plough on behalf of Save the Standing Rock Garden. Plough had argued in his objection, filed in December, that Graham had erred in his …

Magistrate's order issued Wednesday, made public today
A Portage County magistrate has ruled that several requests for an injunction to stop the relocation of the Kent Wells Sherman House to 247 N. Water St. have all been denied by the court. Portage County magistrate Kent Graham issued his ruling in the case Wednesday, and the order became public for the first time this afternoon, essentially allowing the relocation of the house to the vacant lot between the Scribbles Coffee building and the Standing Rock Cultural Arts gallery. Kent residents under the banner Save the Standing Rock Garden filed requests for injunctions last month against the Kent Architectural Review Board, Kent Planning Commission and the Kent Wells Sherman House, Inc., board to try and stop the relocation of the historic …

Portage magistrate denies request for preliminary injunction to stop relocation of house to North Water Street lot
Today's deadline threatening demolition of the Kent Wells Sherman House if it was not moved from land owned by Kent State University appears flexible after all. News came Friday that a Portage County magistrate had denied a request from a group of Kent residents looking to stop the relocation of the historic house to a vacant lot at 247 N. Water St. The house, which had to be moved for construction of Kent State's Esplanade extension, was temporary relocated to a small parcel of university land at the western end of East College Avenue in August. Both university and city officials said the house had to be moved from that locale by today or it would be demolished so it did not interfere with city plow trucks that use that dead-end portion …

Magistrate issued order this week in case
A Portage County magistrate has issued an order denying a request from a group of Kent residents to stop the relocation of the historic Kent Wells Sherman House to a vacant lot at 247 N. Water St. Portage magistrate Kent Graham issued the ruling this week, which denies the request of members of the group Save the Standing Rock Garden for a preliminary injunction to stop placement of the house on the lot. "The motion for a preliminary injunction ... prohibiting (Kent) Wells Sherman House, Inc., from disturbing or removing trees, plants, and soils, making any excavation, and placing structures or equipment on its property located at 247 N. Water St. ... is denied," the magistrate's ruling reads in part. Check back with Kent Patch for updates…

Final briefs filed by attorneys this week; magistrate's ruling pending
A court decision may be near in the case involving an appeal to stop the relocation of the historic Kent Wells Sherman House. Attorneys for three of the parties in the case, Save the Standing Rock Garden, Kent Wells Sherman House, Inc., and the city of Kent, all filed final briefs in the case Tuesday with Portage County magistrate Kent Graham. Kent attorney John Plough, representing the Standing Rock garden group that's trying to stop the relocation, filed an 11-page brief. The city of Kent filed a 28-page final brief, and the attorney for the Kent Wells Sherman House group filed a four-page final statement. It's unclear when Graham will deliver his order in the case. Stay tuned to Kent Patch for updates to this story. RECENT COVERAGE:

Court appeal by citizens group has hearing on permanent injunction request Tuesday
The court battle over the relocation of the historic Kent Wells Sherman House has so far slowed the project with a temporary restraining order. Portage County Common Pleas Court Judge John Enlow issued a temporary injunction on behalf of the Kent citizens' group titled "Save the Standing Rock Garden," comprised of supporters of the Standing Rock Cultural Arts, that temporarily stops site work at 247 N. Water St. for relocation of the historic house. Enlow issued the temporary order this month. The group originally filed an appeal to the September planning commission ruling that approved a site plan for the historic house at 247 N. Water St. Roger Thurman, vice president of the Kent Wells Sherman House Inc. board, which is working to …

Common please court filing alleges commission decision "unconstitutional"
A group of Kent residents trying to preserve a small patch of greenspace are asking a Portage County judge to overturn a ruling by the Kent Planning Commission allowing the relocation of the historic Kent Wells Sherman House. The group titled "Save the Standing Rock Garden," comprised of supporters of the Standing Rock Cultural Arts, filed an appeal in Portage County Common Pleas court this month to the September planning commission ruling that approved a site plan for the historic house at 247 N. Water St. The appeal seeks to overturn the commission's approval of the site plan, which permits relocation of the house to the lot that has been used by the arts group for the past 20 years.
