Magistrate's order issued Wednesday, made public today
A Portage County magistrate has ruled that several requests for an injunction to stop the relocation of the Kent Wells Sherman House to 247 N. Water St. have all been denied by the court. Portage County magistrate Kent Graham issued his ruling in the case Wednesday, and the order became public for the first time this afternoon, essentially allowing the relocation of the house to the vacant lot between the Scribbles Coffee building and the Standing Rock Cultural Arts gallery. Final briefs filed by attorneys this week; magistrate's ruling pending
A court decision may be near in the case involving an appeal to stop the relocation of the historic Kent Wells Sherman House. Attorneys for three of the parties in the case, Save the Standing Rock Garden, Kent Wells Sherman House, Inc., and the city of Kent, all filed final briefs in the case Tuesday with Portage County magistrate Kent Graham. Kent attorney John Plough, representing the Standing Rock garden group that's trying to stop the relocation, filed an 11-page brief. The city of Kent filed a 28-page final brief, and the attorney for the Kent Wells Sherman House group filed a four-page final statement. It's unclear when Graham will deliver his order in the case. Portage magistrate closes second, full day of trial
A court decision may be near in the case involving an appeal to stop the relocation of the historic Kent Wells Sherman House. Portage County Magistrate Kent Graham listened to a second, full day of witness testimony Wednesday before making several modifications to a temporary injunction order regarding the relocation of the house to 247 N. Water St. Kent Assistant Law Director Eric Fink said in a telephone interview after the court proceedings concluded Wednesday that Graham had ordered the final arguments and trial briefs be submitted to the court by Tuesday at 4 p.m. "There will be no further testimony taken," Fink said. Alec, the people who have raised their voices to oppose the move of the house are certainly passionate about it, but they are not most Kent residents. They are a vocal small group of residents. I admire their willingness to stand up for what they believe, even though I disagree with them on this issue. But they are not most people in the city.
