Charges Dropped, Reduced in Kent State Twitter Threat Case

William Koberna taken off court ordered GPS monitoring device

The Kent State University student at the center of is no longer facing a felony charge in the case following a court hearing this morning.

Judge Barbara Oswick this morning reduced a  first-degree felony charge of inducing panic originally filed Monday against William Koberna, 19, of Brunswick, to a first-degree telecommunications harrassment charge.

The lesser charge stemmed from an indictment issued on the telecommunications charge Thursday by a Portage County grand jury.

Kent State Police charged Koberna Monday with inducing panic, a fifth-degree felony, and aggravated menacing, a first-degree misdemeanor, after Koberna reportedly posted a message on Twitter in which he threatened to use a fire arm on campus.

Oswick dropped the charge of aggravated menacing this morning.

The judge also removed a condition of Koberna's release on bond earlier this week that had required him to wear a GPS monitoring bracelet. That decision was made at the request of Koberna's attorney, Paul Cristallo.

Koberna's attorney argued, in part, that the GPS monitoring would potentially limit his client's ability to apply to other colleges.

"He doesn't own a gun," Cristallo said. "There are no weapons in his home."

Cristallo said his client was a 2010 honors graduate from Brunswick High School and also made the dean's list during his time at Kent State.

The tweet, posted late last month, reportedly included profanity directed at Kent State President Lester Lefton and also stated "I'm shooting up your school ASAP," according to Ohio.com.

Oswick with the other two requirements that he be barred from setting foot on any Kent State campus and that he have no contact with Kent State President Lester Lefton intact.

Koberna, who appeared in court wearing black dress slacks and a dark blue polo shirt, said little to the judge other than "Yes, mam" and "No, mam" in response to her questions.

After the hearing, Koberna left the courthouse with his parents and attorney celebrating the fact the felony charge had been dropped.

Portage County Prosecutor Victor Vigluicci issued a press release this morning stating that because Koberna still faces the telecommunications harrassment charge his case will remain in Portage County Municipal Court for further adjudication.

If found guilty, the telecommunications charge carries a maximum sentence of six months in jail and a $1,000 fine.

The sophomore has been placed on interim suspension by Kent State "pending due process of criminal charges," according to university officials.

Hmmm...having lived through 2 campus gun events, I'd like to see him in a GPS monitor. Let him apply to an online school or get permission (register a location) to visit other schools. If its an ankle bracelet, it shouldn't be noticeable in an interview/school visit. If it is noticed, well, that's just a "benefit" of inducing panic (admitting, here, my ignorance on the exact specifications of a GPS monitoring devices).

Yes, that's the only charge that remains against him — a first-degree misdemeanor.

Yes, I didnt think they would have found any weapons in his home : ) While his twitter post was immature and childish....and he might have been venting, he must face consequences... I'm glad this ended so well and I wish Mr. Koberna much success. Expensive lesson but one that had to be learned.

I definitely feel he should have to wear a monitor for a much longer period. He gave up his right to privacy when he threatened the lives of students and faculty. I feel like a slap on the wrist is giving the public the wrong message. There should be ZERO tolerance!

Paula, While I believe there are truly good people out there who have nothing but the bestRead More intentions for others, this story does not shock nor surprise me. I attended meetings with a friend who was court ordered. They couldn't drive and I figured I would sit with them instead of driving back and forth. AA claims not to be a religious sect but all the meetings and steps center around God. Not that I have a problem with God, but some people don't believe. Our courts (Judges) sentence people to attend meetings for DUI. I find this sad and irresponsible. One, it's religion. Two, you are sending alcoholics in to a group of other alcoholics who are not trained to help people with addiction. AA teaches people they are "helpless and powerless". Really? An individual has to find strength from within to fight the addiction. Telling people they are helpless isn't going to help. Alcoholism is usually tied to mental issues or illness. Going into a room and listening to other people's depressing rock bottom stories made me want to leave and go drink. Paradise Club....... hmmmmmmm...... I am not surprised. The only reason these court ordered sessions continue is that it doesn't cost the court any money. DUI's are a money maker for the courts, police and all the attorney's out there. Ah, but that's another story. I hope there is a happy ending for all of those above and others like them who have suffered under the guise of AA.

Maybe it is just the start to a slow summer or a sign that there is nothing interesting going on inRead More Kent. The story you mentioned turned out to be pretty uneventful and more about a guy making false, not real, threats. The two stories that have seen the most face-time have been KRHS's valedictorian and the med helicopter. Maybe highlight achievements and products of local businesses we don't hear about. Run an interesting historical piece. Not trying to be argumentative but rather making a comment that the information provided as of late has been less than interesting.

I'm glad the League did their research. Have they ever researched and said: "no, we dont feelRead More the levy is needed?" For most of us, our research need only go as far as our wallets and income. If the schools with their million dollar budgets are feeling the crunch, imagine how average or lower average income homes are struggling. I am very suspect of the excellent w/ distincton rating and the asking of this levy at this time. How were we able to get that kind of incredible rating with NO ADDED FUNDS? Did the teachers wake up last year? Did the kids wake up? How did the school get such superior ratings THAT year and none in previous ones? why such a huge gap in time and ratings? The days of passing every school levy "just because", "we've never said no", "for the kids" or to keep our "property values" are over. The economy took care of that. No matter how you feel about the levy: PLEASE VOTE.

I urge my fellow residents to send a message to the school board: The Board needs to face the factRead More of the current economic conditions involving the residents in the Kent city school district and come back with a request for a more reasonable millage. Otherwise, I think the levy will fail. Our city leaders encouraged businesses to come into the new development by granting concessions on taxes. Well, there goes the additional money!
